Balthazar Getty has been married to Rosetta Millington for about eight years now, so he probably hoped to keep his Italian holiday with Sienna Miller a bit discreet. That didn’t work out, thanks to paparazzi pics of the happy and nearly naked couple getting all over each other like a couple of rashes. (Disconcertingly, Balthazar’s own left moob is tattooed with the name “Rosetta,” which seems like it ought to have had a chilling effect on the romance. Not so, evidently.) Now that the pics have appeared on 97 million web pages, more or less, Balthazar is bowing to the inevitable and publicly announcing the end of his marriage:

In light of the fact that many pictures have surfaced in print and on the Internet which has caused myself and my family great embarrassment, I felt it necessary to at least acknowledge publicly that yes indeed my wife and I have separated and I will not be commenting any further.

Meanwhile, Sienna is taking a somewhat more kick-ass approach to the incident. The star is bringing a breach of privacy suit against Big Pictures, the pap agency that originally sold the pictures, as well as the Sun and News of the World, Big Pictures’ eager clients. (Both papers have since taken down the pics and the accompanying articles from their websites.) The lawsuit isn’t exactly an empty threat; last year Sienna sued the same two papers for carrying nude pics from the set of her upcoming film Hippie Hippie Shake and won $75,000, a huge settlement by UK standards. It’s nice to see someone taking the fight to the paparazzi, an even more predatory and annoying bunch than gossip bloggers. That said, Sienna seems to have a real problem with keeping her clothes on.
